Terms and Conditions

1. Membership of REP

 

Membership of REP and access to REP Member pages and Zoom Events is conditional upon the payment of the appropriate subscription fee.

 

  • You must be over 18 years of age to become a member.

  • Your Membership Subscription is valid for the Membership Subscription Term of twelve months.

  • Your Membership Subscription will be due for renewal on the 1st January each year, regardless as to when you joined.  Members subscribing on or after 1st July will only be required to pay 50% of the appropriate subscription fee and then the full fee on the following 1st January.

  • Membership Subscription is non-transferable, should you not be able to attend play readings, you may not send a substitute; you may view the recorded play reading up to 14 days after the event (see Sections 5 and 6).

  • Membership Subscription will not automatically renew. Members are responsible for renewing their own subscription annually after January 1st. 

  • Cancellation: Members shall have a right to cancel their Membership Subscription within 14 days

  • Refunds: Members cancelling their Membership Subscription within 14 days are eligible for a full refund by contacting Polly Sullivan polly.sullivan.rep@gmail.com Members cancelling their Membership Subscription after 14 days are not eligible for a refund. 

  • In the event of Force Majeure, REP shall not be deemed to be in breach of these Terms and Conditions and in particular shall not be liable for a delay or for non-performance of any of its obligations under these Terms and Conditions or for any loss or damage occasioned thereby. To the maximum extent permitted by law, all losses arising, for this reason, shall not be recoverable by the Member.

  • At its absolute discretion, REP may at any time alter, amend, change, modify or withdraw any of the Membership benefits that comprise the Membership offering.

  • While REP will endeavour to inform Members of any such changes, it will ultimately be the responsibility of Members to keep up-to-date with all such changes. Membership renewal and continued use of the Member Services shall be deemed acceptance of any changes to these Terms and Conditions.

  • Any notice to be given under these Terms and Conditions shall be in writing, which shall include electronic communication to the email address you provide.

  • All rights, including copyright, in this website, are owned by or licensed to REP. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute, or repost anything on this website for any purpose.

  • We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

2. Accessing REP’s Website

 

  • Access to REP’s website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). REP will not be liable if for any reason its site is unavailable at any time or for any period.

  • From time to time, REP may restrict access to some parts of its site, or its entire site, to users.

  • REP will determine, in its discretion, whether there has been a breach of these terms. Where a breach of these terms has occurred, we may take such action as we deem appropriate, which may result in us taking all or any of the following actions:

    • Immediate, temporary or permanent withdrawal of your right to use our site.

    • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.

    • Issue of a warning to you.

    • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.  Further legal action against you.

    • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

3. Reliance on Information Posted

  • Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We, therefore, disclaim all liability and responsibility arising from any reliance placed on such materials by the user or member of our site, or by anyone who may be informed of any of its contents.

  • Members should not rely on any materials posted on our site for personal, medical, legal, financial or any other type of advice and we strongly recommend that you consult an appropriately qualified professional where necessary.

4. Intellectual Property Rights

  • REP is the owner or the licensee of all intellectual property rights in its site, and in the material published on it. These works are protected by copyright laws and treaties around the world. All such rights are reserved.

  • Members must not modify the paper or digital copies of any materials they have printed off or downloaded in any way, and they must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

  • REP’s status (and that of any identified contributors) as the author(s) of material on our site must always be acknowledged.

  • Members must not use any part of the materials on REP’s site for commercial purposes without obtaining a licence to do so from us or our licensors.

  • If Members print off, copy or download any part of REP’s site in breach of these terms of use, their right to use our site will cease immediately and they must, at our option, return or destroy any copies of the materials they have made.

5. Recordings and Privacy​

  • The play readings are recorded and stored in the REP archive.

  • Members who attend the play readings in real time will receive a notification on their screens when the recording begins and will have the option to continue or to leave the reading.

  • The presence of Members after this notification will be deemed as consent.

  • Zoom only records the Member who is speaking. Auditors will not appear in the recordings.

  • Each recording will be password protected and only viewable by Members of REP.

  • Each recording will be available to view via the website for fourteen days, after which point the link will expire.

  • Please treat each recording as a confidential file.

  • By accessing the recordings, you agree not to attempt to save it, copy it, share it, or use it for any other purpose than catching up with a play reading you were unable to attend in real time.

  • The recordings will be stored in the REP archive and held in readiness by the organising committee for research purposes.

  • If you feature in any of the recordings (i.e. you read a role and appear on screen), you reserve the right to request a permanent, downloadable copy of the material.

  • REP will not share this data without obtaining the necessary consent from the Members involved.

6. REP’s Site Changes Regularly

  • REP aims to update its site regularly, and may change the content, including but not limited to the charges associated with the use of its site at any time. If the need arises, REP may suspend access to its site, or close it indefinitely. Any of the material on REP’s site may be out of date at any given time and we are under no obligation to update such material.

7. Code of Conduct

  • At all times you shall conduct yourself in your relations with other Members or their guests or the General Public or Third Parties in a responsible and careful manner. Members failing to behave correctly will have their membership cancelled and no refund will be offered.

  • Members agree that their contributions will not:

    • Contain any material which is defamatory of any person.

    • Contain any material which is obscene, offensive, hateful, or inflammatory.

    • Infringe any copyright, database right, or trademark of any other person.

    • Be likely to deceive any person.

    • Promote sexually explicit material.

    • Promote violence.

    • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

    • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

    • Promote any illegal activity.

    • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience, or needless anxiety.

    • Be likely to harass, upset, embarrass, alarm, or annoy any other person.

    • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.

    • Give the impression that you emanate from us, if this is not the case.

    • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

    • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.

    • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.

    • Advertise or offer to sell or buy any goods or services for any business purpose, unless our site specifically allows such messages.

    • Conduct or forward surveys, contests, pyramid schemes or chain letters.

    • Download any file posted by another user of our site that you know, or reasonably should know, cannot be legally distributed in such manner.

    • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

    • Restrict or inhibit any other user from using and enjoying our site.

    • Violate any code of conduct or other guidelines which may be applicable for our site.

    • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.

  • REP is under no obligation to monitor the contributions; however, it reserves the right to review the contributions and to remove them.

  • REP also reserves the right to terminate your access to any or all our Sites at any time without notice for any reason whatsoever.

  • Always use caution when giving out information about yourself in any contribution. We do not control or endorse the content, messages or information found in any contribution and, therefore we disclaim all liability with regard to the contribution and any actions resulting from your participation in any contribution.

  • Our Hosts are not our authorized spokespersons, and their views and contributions do not necessarily reflect the views of REP.

  • Contributions may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

8. Data Protection

  • REP will take all reasonable precautions to keep the details of your applications and payment secure, but unless REP is negligent, it will not be liable for unauthorised access to information supplied by you and in any event only to the value of the transaction conducted with REP.

  • REP shall have no responsibility for loss or damage sustained by you arising from the passage of any computer virus or other damaging electronic message.

  • For your security and peace of mind, REP will not supply your details to any organisation for marketing purposes.

  • From time to time, REP may send event feedback questionnaires to all Members. We politely ask that you complete these questionnaires to enable us to gather the information and continue to shape and form REP to the Members’ needs and requirements.

9. Indemnity

  • You agree to indemnify and hold REP harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or arising from your negligence or breach of duty.
